Understanding What To Do

For immigrants lacking proper documentation, the guidance is straightforward: don’t say anything, don’t sign anything, and always consult an attorney before opening your door to Immigration and Customs Enforcement agents. At Martinez Immigration Law LLC, we’re here to help you navigate these challenging situations.

Checklist for Red Card Instructions

  • 1. Do Not Open the Door

    • If an immigration agent knocks, do not open the door.
  • 2. Stay Silent

    • Do not answer any questions from immigration agents.
    • Exercise your right to remain silent.
  • 3. Do Not Sign Anything

    • Never sign any documents without first consulting with a lawyer.
    • Understand that signing could result in expedited deportation.
  • 4. Ask if You’re Free to Leave (if outside your home)

    • If you are outside, ask the agent if you are free to leave.
    • If the agent says yes, leave calmly.
  • 5. Use the Red Card

Show the Red Card through a window or pass it under the door if you are inside your home.

    The card states:

    • You do not wish to speak, sign, or hand over documents.
    • You deny access to your home without a warrant.
    • You assert your Fifth and Fourth Amendment rights.
  • 6. Do Not Be Pressured to Sign a Deportation Order

    • Understand that you have the right to a deportation hearing.
    • Be aware that ICE officers may pressure you to sign an expedited removal order—do not sign.
