What is TPS?

Temporary Protected Status (TPS) is a type of immigration relief available to people from certain countries. The Department of Homeland Security (DHS) chooses which countries are designated. DHS may designate a country for TPS if it is experiencing natural disasters, armed conflicts, or other temporarily unsafe conditions. Benefits of TPS

If an applicant is granted TPS, they are granted temporary permission to live in the U.S. without fear of being removed. TPS does not lead to any other immigration status. However, TPS people with TPS approval are eligible for a work permit (EAD).


TPS is granted for a specific period of time, usually 6-18 months, and must be renewed. At the end of a country’s designated period, DHS reviews the country’s conditions to decide if TPS should be extended. If DHS extends TPS for a country, applicants must re-register to maintain TPS benefits.

Application Process

  1. Submit Form I-821 to USCIS.
  2. To apply for an Employment Authorization Document (EAD), submit Form I-765.
  3. After filing a TPS application, applicants may receive a notice to attend a biometrics appointment with USCIS, to take their fingerprints and photographs.
  4. If an applicant is granted TPS, they must re-register during each re-registration period for their country to maintain TPS benefits.
